Land Transfers (whether for value, by gift or pursuant to testamentary transfer) are not simple transactions because the documents require vetting for accuracy and processing by at least two separate government agencies, i.e the Stamp Duty and Transfer Tax Division of Tax Administration Jamaica (TAJ) and the National Land Agency. Individuals are encouraged to retain an Attorney to assist them in order to ensure transfer documents are in proper form and to avoid delays.
Land Transfers require payment of government taxes and fees before they can be given effect. Transfer Tax of 2% and Stamp Duty of J$2,500 as well as Registration Fee of 0.05% of the property's Market Value are payable under ordinary circumstances unless exemptions are applicable.
Land Transfers can not proceed without the parties having a Tax Registration Number (TRN), unless legally exempt, and Property Taxes must be up-to-date. Note also that land transfers may take 4-8 weeks to be completed from the time the documents are first lodged for tax assessment at TAJ's Stamp Duty and Transfer Tax Division.
